This document is an official offer (public offer) regarding consulting services provided by sole proprietor Kostenko Oleksandr Mykolayovych.

This English version is provided for convenience. In case of any discrepancy, the Ukrainian version of the Public Offer Agreement is the official and controlling version.

1. General provisions

This document is an official proposal (public offer) regarding consulting services provided by sole proprietor Kostenko Oleksandr Mykolayovych, EDRPOU code 2467811012 (hereinafter - the Contractor), to conclude an agreement for the provision of consulting services offline and online by using free closed-source software that enables encrypted voice and video communication over the Internet between computers in ZOOM and Google Meet, and is addressed to individuals (hereinafter - Clients).

If you accept the proposed services, you are considered to fully and unconditionally agree with all the terms of the proposal below (public offer), accept it in full and without reservation, including agreeing to perform all obligations imposed on you by it, and confirm that all its provisions are clear to you.

In accordance with Article 641 of the Civil Code of Ukraine, if an individual accepts the terms set out below and pays for the services, that individual accepts this offer, concludes the public offer agreement and becomes a Client.

Acceptance of the Agreement means the Client’s full and unconditional acceptance of all its terms without any exceptions or restrictions.

In accordance with Article 642 of the Civil Code of Ukraine, the Client confirms acceptance of the Agreement after reviewing its terms and the Rules placed at the Contractor’s reception by paying for the Contractor’s services.

An agreement concluded by the Client through acceptance of the public offer has legal force in accordance with Article 642 of the Civil Code of Ukraine, is equivalent to an agreement signed by the Parties, and is deemed to confirm that the Client has reviewed and agreed to the terms of this public offer.

Hereinafter in the Agreement, the Contractor and the Client are jointly referred to as the “Parties” and individually as a “Party”. Each Party guarantees to the other Party that it has the necessary legal capacity, rights and authority sufficient to conclude and perform the Agreement in accordance with its terms.

2. Subject of the Agreement

The Contractor, under the terms of this Agreement (public offer), undertakes to provide the Client with a one-time consulting service or a set of services determined by the subscription terms according to the Price List (Appendix No. 1), which is an integral part of the Agreement, and the Client undertakes to pay for and receive these services under the terms of this Agreement.

3. Rights and obligations of the Parties

The Contractor must:

  • ask whether the Client has any medical contraindications to receiving a consultation;
  • ensure the proper quality of the services provided;
  • ensure the proper functioning of equipment;
  • be responsible for the quality of the services provided in accordance with this Agreement and Ukrainian law;
  • before providing services, familiarize the Client with the Rules of conduct and ethical standards for individual and group consultations;
  • inform the Client that information about the content of the consultation and about the Client, obtained during the consultation, is strictly confidential and may not be disclosed; the Client is prohibited from recording the consultation on any digital, analog or other medium and from further using such recordings.

The Contractor has the right to:

  • refuse admission to Clients under the influence of alcohol or drugs;
  • refuse admission to Clients with inadequate behavior;
  • refuse admission to Clients who violate the Rules of conduct and ethical standards;
  • refuse admission to Clients whose actions threaten the health, property, honor or dignity of other Clients;
  • refuse admission where the Client has medical contraindications for attending the consultation, including various dependencies, syndromes and disorders, related diseases, psychotic and acute states, or pathological crises;
  • unilaterally amend the terms of this Agreement.

The Client must:

  • carefully review the terms of this Agreement and, after choosing services, pay for them;
  • inform the Contractor of any medical contraindications and illnesses;
  • if contraindications exist, provide an extract from the medical institution that provides ongoing medical care, containing recommendations from the treating physician;
  • strictly comply with the Rules of conduct and ethical standards;
  • treat other participants in group consultations with respect;
  • in case of damage, compensate it in full; the amount of compensation is determined by the Contractor.

The Client has the right to:

  • receive all services offered in clause 2.1 of this Agreement;
  • pay for the Contractor’s services only in the manner provided by this Agreement;
  • attend consultations according to the agreed schedule.

4. Payment procedure

The Client must pay 100% of the selected consulting services according to the price list and issued invoice.

The subscription fee is paid before the first visit. The Client has the right to make payment by cashless transfer in the national currency of Ukraine.

After the Client pays for a one-time consultation or selected subscription type, the Client is given the opportunity to receive the paid services.

5. Rules of conduct

In the offline or online space where the consultation is held, the Rules of conduct and ethical standards must be observed.

6. Term of the Agreement and early termination procedure

The term of the Agreement coincides with the term of the subscription purchased by the Client.

The Agreement is considered extended if the Client purchases the next subscription.

The Agreement may be terminated early unilaterally at the Contractor’s initiative in the following cases:

  • gross violation by the Client of the Rules or terms of this Agreement;
  • violation by the Client of the subscription payment procedure, agreed schedule or timing of planned consultations;
  • detection or existence of contraindications in the Client that create a threat to the life or health of the Client, the consultant or others.

If the Agreement is terminated early at the Contractor’s initiative, the Contractor does not refund money for the subscription paid by the Client.

The Agreement may be terminated at the Client’s initiative if the service was not provided by the Contractor or if the provided consultation did not correspond to the Client’s initial request. In this case, the Contractor returns the funds transferred by the Client to the Contractor.

If the Agreement is terminated early at the Client’s initiative, funds paid to the Contractor are returned provided that the Agreement is terminated no later than 24 hours before the start of the planned consultation.

7. Dispute resolution

All disputes and disagreements that have arisen or may arise in connection with this Agreement are subject to resolution through negotiations based on a written statement from the Client.

The Client’s statement is reviewed within 14 (fourteen) days from the moment of receipt.

If the dispute is not resolved through the claims procedure, either Party has the right to apply to court at the Contractor’s location.

8. Liability for breach of the Agreement

The Contractor is not liable for the Client’s unmet expectations.

The Client is personally responsible for their health.

Each Client is personally responsible for their own safety and for the safety of people around them.

9. Other terms and Contractor details

The Client guarantees that all terms of this Agreement and the Rules are clear to them and that they accept them unconditionally and in full.

This Agreement is concluded by the Client’s acceptance of this public offer, which contains all essential terms of the Agreement.

The user consents to the Contractor’s use of their personal data.

In matters not regulated by this Agreement, the Contractor and the Client must be guided by the rules established by Ukrainian law.

In accordance with the Law of Ukraine “On Personal Data Protection” No. 2297-VI dated 01.06.2010, the Client gives unconditional consent to the processing of their personal data provided to the Contractor as a result of legal relations. Payment for a subscription or one-time visit by the Client means unequivocal consent to the above and confirms that the Client has read Article 8 of the Law of Ukraine “On Personal Data Protection”.

Rules of conduct and ethical standards for clients of Workshop of Destiny

1. General principles

“Workshop of Destiny” is a safe, respectful and confidential space for psychological, coaching and transformational work.

The purpose of these rules is to support an atmosphere of trust, dignity, inner safety and mutual respect during individual and group meetings.

Participation in sessions, consultations and group formats implies the client’s consent to these rules.

2. Basic interaction standards

While participating in the work of Workshop of Destiny, each client undertakes to:

  • treat the session leader, consultant and other participants with respect;
  • maintain a correct tone of communication;
  • not humiliate, devalue, mock or provoke others;
  • not move into personal insults, accusations, pressure, manipulation or aggression;
  • not impose their beliefs, evaluations, life views or way of thinking on others;
  • recognize every person’s right to their own experience, pace of change, boundaries and way of self-expression.

3. Interaction with the session leader / consultant

In work with a specialist, it is important to maintain a professional format of contact. Therefore, the client must:

  • respect the role of the leader and the boundaries of the consultation process;
  • avoid rudeness, pressure, overfamiliarity, aggressive statements or devaluation of the specialist’s professional position;
  • not demand actions from the leader that go beyond the agreed work format;
  • not use the session as a space for conflict, psychological pressure or testing the specialist’s boundaries;
  • accept that the leader has the right to calmly stop non-constructive communication, redirect the conversation or end the cooperation format in case of systematic violation of ethical standards.

4. Conduct in group consultations and programs

In group formats, each participant is responsible not only for themselves, but also for the quality of the shared space. Therefore, the following rules apply in the group:

  • speak in turn and do not interrupt others;
  • do not give unsolicited advice;
  • do not interpret, “diagnose” or evaluate other participants;
  • do not enter disputes for the purpose of proving your point;
  • do not take up all the space with yourself, leaving room for others;
  • do not use the group for self-assertion, criticism or emotional dominance;
  • follow the principle: “I speak about myself and from my own experience,” rather than about how others “should” be.

5. Sensitive and undesirable topics

To preserve a safe environment in Workshop of Destiny, initiating, developing or imposing discussions on topics that may create tension, division, conflict or psychological discomfort for other participants is not encouraged.

Such topics include, in particular:

  • political views and political disputes;
  • national, ethnic or language issues;
  • religious, spiritual or worldview beliefs in the form of debate or persuasion;
  • issues of income, financial status or material wealth of other people;
  • comparisons of people by social, cultural, family or any other status;
  • any other topics presented in the form of judgment, opposition, imposition or polemics.

At the same time, if a certain topic is part of the client’s personal request, it may be carefully and ecologically considered within therapeutic or coaching work, without turning into a public discussion, without evaluating others and without violating group safety.

6. Confidentiality

Everything that is said during individual and group sessions belongs to a space of trust.

The client undertakes to:

  • not disclose personal information about other participants;
  • not transfer to third parties the content of other people’s stories, statements, experiences or circumstances;
  • not record audio, video or screenshots without separate permission;
  • not take outside the group anything that may violate the privacy or dignity of other people.

Violation of confidentiality is a serious violation of the ethical standards of the space.

7. Personal boundaries

Workshop of Destiny respects the personal, emotional and communication boundaries of each person.

This means that the following are not allowed:

  • psychological pressure on other participants;
  • forcing openness;
  • demanding answers to uncomfortable questions;
  • devaluing another person’s experiences;
  • intruding into personal space;
  • unsolicited personal contacts, messages or pursuit of other participants outside the agreed format.

Everyone has the right to say: “I am not ready to talk about this,” “This is too personal for me,” “I want to keep this boundary.”

8. Respect for time and format

Organizational discipline is important for quality work.

The client undertakes to:

  • arrive at sessions on time;
  • notify in advance about lateness or inability to participate;
  • ensure a calm, private place without third parties for online meetings;
  • not participate in a session while driving, in a public noisy place or in circumstances that make quality and safe work impossible;
  • be in a state that allows conscious participation in the process.

9. Unacceptable forms of behavior

In the space of Workshop of Destiny, the following are categorically unacceptable:

  • insults, rudeness and humiliation;
  • aggressive communication;
  • discriminatory, humiliating or provocative statements;
  • sexualized comments or violation of personal inviolability;
  • manipulation, blackmail and pressure;
  • intentional creation of conflicts in the group;
  • being present at a session in a state that makes adequate contact and interaction impossible.

10. The leader’s right to preserve a safe space

The session leader / consultant has the right to:

  • stop incorrect behavior;
  • name violations of boundaries or rules;
  • limit participation in the group process;
  • terminate a session or cooperation format early in case of gross or systematic violation of ethical standards;
  • refuse further participation in a program if the client’s behavior harms the safety of the space, the leader or other participants.

Such decisions are made not as punishment, but as a way to protect professional boundaries, psychological safety and the quality of work.

11. Client’s personal responsibility

Participation in sessions and programs implies the client’s personal responsibility for:

  • their own behavior;
  • their way of communication;
  • respect for other people’s boundaries;
  • the voluntary nature of their participation;
  • careful treatment of the space created for inner work.

Workshop of Destiny supports a mature, conscious and ethical format of interaction in which respect, dignity and safety are no less important than the result of the work itself.

12. Summary

We believe that deep transformation is possible only where there is respect, confidentiality, boundaries, quiet without judgment and humanity.

That is why these rules are not a formality, but the foundation of a space where a person can be themselves without defending against danger from outside.
